By accessing or using the Apex Website Development website (the "Site") and our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

Apex Website Development provides custom website design, development, search engine optimization (SEO), e-commerce, performance optimization, and ongoing support services. The specific scope, deliverables, timeline, and fees for any project are defined in a separate written agreement or proposal between you and us.

In the event of any conflict between these Terms and a signed project agreement, the project agreement governs with respect to that project.

All quotes provided are estimates based on the information you share with us at the time of the request. Final pricing is agreed upon in a written proposal before work begins. We reserve the right to revise a quote if the scope of a project changes significantly after the original estimate is provided.

You agree not to:

• Use the Site in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Site, its systems, or networks.
• Introduce viruses, malware, or any other malicious or harmful code to the Site.
• Scrape, copy, or republish content from the Site without our prior written consent.
• Use the Site to send unsolicited communications or spam.

We may suspend or terminate access to the Site for anyone who violates these Terms.

The Site and its original content — including text, graphics, logos, and design — are the property of Apex Website Development and are protected by intellectual property laws. You may not use our branding or content without our written permission.

Upon full payment of all agreed fees, you own the final website code and content we create specifically for you, subject to any third-party licenses (such as stock imagery, fonts, or open-source libraries) which remain governed by their respective terms.

To help us deliver your project successfully, you agree to provide timely and accurate information, content, and feedback, and to meet agreed-upon deadlines. Delays caused by late or incomplete client input may affect project timelines and may incur additional fees as outlined in your project agreement.

Payment schedules are specified in your project agreement. Unless otherwise agreed, invoices are due within the period stated on the invoice. Late payments may result in the suspension of work or services until the balance is settled. A deposit may be required before work begins; deposits are generally non-refundable once work has commenced.

Each project includes a defined number of revision rounds as stated in your proposal. Additional revisions beyond the agreed scope may be billed at our standard hourly rate. Because our services are custom and labor-based, refunds are handled on a case-by-case basis as described in your project agreement. Work already completed and approved is generally non-refundable.

Our websites may integrate third-party services such as hosting providers, payment processors, analytics, and external APIs. We are not responsible for the availability, performance, or practices of these third parties. You are responsible for any fees or terms associated with third-party services you choose to use in connection with your website.

To the fullest extent permitted by law, Apex Website Development shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits, data, or business, arising out of or related to your use of the Site or our services. Our total liability for any claim arising from our services is limited to the amount you paid us for the specific project giving rise to the claim.

The Site and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that any specific search engine ranking or business result will be achieved.

We may suspend or terminate your access to the Site or discontinue services if you breach these Terms or your project agreement. Upon termination, any amounts owed for work completed up to that point remain payable.

We may update these Terms from time to time. Changes will be posted on this page with a revised "last updated" date. Your continued use of the Site or services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.
